FINGOGIN TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using the fingogin website (the "Platform"), creating an account, or interacting with our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

2. ELIGIBILITY

To use the Services, you represent and warrant that:

1. Age: You are at least 18 years old or of legal age to form a binding contract under applicable law.
2. Jurisdiction: You are not a resident, citizen, or located in a restricted jurisdiction, including but not limited to the United States, North Korea, Iran, Syria, Cuba, Crimea, or any other jurisdiction where the Services are prohibited by law ("Restricted Jurisdictions").
3. Capacity: You have the full right, power, and authority to enter into these Terms.

3. ACCOUNT REGISTRATION AND SECURITY

1. Account Creation: You may access the Platform via Google Authorization or Email Verification. You are responsible for maintaining the confidentiality of your login credentials.
2. Payment Password: You are responsible for setting and safeguarding your secure Payment Password. fingogin cannot reset this password if lost in a decentralized context, and you bear the risk of loss regarding access to your funds.
3. Account Activity: You are responsible for all activities that occur under your account. fingogin reserves the right to suspend or terminate accounts that suspect of suspicious activity, botting, or violation of these Terms.

4. PREDICTION MARKETS AND TRADING RULES

4.1. Nature of Services

fingogin provides a platform for users to predict the outcome of future financial events (e.g., Nasdaq closing price, Crypto market cap). These are prediction contracts, not investment products or securities.

4.2. No Order Cancellation

ALL PREDICTIONS AND ORDERS ARE FINAL. Once a prediction transaction is submitted and confirmed on the Platform, it cannot be modified, withdrawn, or cancelled by the user. There is no feature to trade or sell your position prior to the event settlement ("No Intraday Trading").

4.3. Market States & Funding

Certain prediction markets operate with a "Funding Phase":

• Funding Success: If the market reaches its required liquidity threshold, it moves to the "Live" state.
• Funding Failure: If the threshold is not met by the deadline, the market is "Cancelled," and your principal funds will be returned to your account without interest or bonus.

4.4. Settlement and Resolution

fingogin reserves the right to determine the outcome of markets based on reliable public data sources (e.g., Bloomberg, Nasdaq, CoinGecko).

• Standard Settlement: Winners share the prize pool according to the platform's specific logic (Pari-mutuel or Fixed Odds as displayed).
• "Egg Mode" (Coverage Failure): If the actual outcome of an event falls outside all available prediction options , fingogin may, at its sole discretion, trigger a "Refund" or "Partial Refund" mechanism.

5. FUNDS, FEES, AND INCENTIVES

5.1. Cash Account

"Cash" refers to cryptocurrency assets deposited by you or won from settlements. These funds are withdrawable to a blockchain wallet, subject to network fees and security reviews.

5.2. Bonus and Points

• Bonus: A promotional balance used to deduct prediction costs. Bonus funds cannot be withdrawn directly.
• Points: A loyalty unit used for specific games (e.g., 5-Minute Guess). Points have no monetary value and cannot be exchanged for cash unless explicitly allowed by a specific, temporary platform event.
• Right to Revoke: fingogin reserves the right to expire, void, or revoke Bonus and Points in cases of account inactivity, abuse, or suspected fraud (e.g., creating multiple accounts to farm referral rewards).

5.3. Fees

fingogin charges a Service Fee on the Net Winnings of successful predictions. The fee schedule is subject to change and is displayed on the Platform interface.

6. USER CONDUCT

You agree not to:

1. Use the Services for money laundering, terrorist financing, or other illegal activities.
2. Engage in "Wash Trading" or collusive behavior to manipulate market volume or leaderboards.
3. Attempt to circumvent our geographical blocking or fee systems.
4. Use bots, scrapers, or automated scripts to interact with the Services without express written permission (except for approved API usage if available).

7. RISK DISCLOSURE

You acknowledge and accept the following risks:

1. Total Loss: Prediction markets are speculative. You may lose the entire amount of funds deployed.
2. Blockchain Risk: Transactions rely on underlying blockchain networks. Delays, high gas fees, or network failures are outside fingogin's control.
3. Regulatory Risk: The regulatory status of prediction markets is evolving. fingogin may restrict or terminate services in your jurisdiction without prior notice to comply with legal requirements.
4. No Advice: Nothing on the Platform constitutes financial, investment, or legal advice.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FINGOGIN EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINGOGIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, rather than in court. The arbitration shall be conducted in a jurisdiction selected by fingogin's operating entity.
